First Time User

This agreement governs use of Tri Valley Bank's online banking services. By clicking “I Agree” following this agreement, you are acknowledging the terms of use for this service and agreeing to them. You should read this online agreement and the related information provided by the Tri Valley Bank prior to using these online services. By using the online banking services of the Tri Valley Bank you agree to abide by the terms and conditions of this Agreement.

The terms “we,” “us,” ”our,” and “Bank” refer to Tri Valley Bank. The words “you,” “your,” and “yours” mean each deposit account owner, authorized deposit account signer, and anyone authorized to act in behalf of a deposit account owner. Accessing Your Bank Accounts Through Online Banking You can access your Tri Valley Bank accounts through online banking. Each of your accounts at the Bank is also governed by your Deposit Agreement and the accompanying disclosures which include Funds Availability, Electronic Funds Transfer, and other related account agreements.

Requirements

To access your personal or business accounts through online banking, you must have an eligible Bank account (checking, NOW, Savings, Certificate of Deposit, or loan), a User ID, and an online banking password. You must enroll in online banking and your enrollment must be approved. Then the Bank will issue you 2 letters which will be sent separately. One letter will contain a temporary password for the first time you log on to the site. You agree to keep this password secret from any individual not authorized to access your account. The other letter will contain a temporary User ID for the first time you log on to the site. After you log on using the temporary User ID and password, you will be required to set up your own User ID and password according to the instructions provided.

You agree that you are solely responsible for acquiring and maintaining a computer or other electronic device that can handle and access the online banking service of the Tri Valley Bank, and that you are responsible for all costs associated with accessing these online services.

Use

Subject to the terms of this agreement, you may use the online banking service to access your eligible accounts, obtain online banking services, and perform authorized transactions through the website. We may from time to time introduce new features to the online banking service. When this happens, we will update our website accordingly.

This agreement does not supersede your other agreements with the Bank. If there is any conflict between this use agreement and your account agreement with the Tri Valley Bank, the account agreement will overrule this agreement. The exception to this rule will be the waiver of the requirement for two or more signatures. You recognize that any requirement of verifying two or more signatures on debits, if such a requirement exists, does not apply to electronic or telephonic transfers and releases us from our liability when making these kinds of transfers. This provision controls and takes precedence over any conflicting provision in any other agreements you have with us.

You authorize Tri Valley Bank to provide access to your eligible accounts through the online banking service. You agree to comply with any security procedures and policies we may establish from time to time. You will generally be able to access your accounts through the website 7 days a week, 24 hours a day. The online service may not be available to you due to maintenance of the system or circumstances beyond our control.

If you violate the terms of this agreement, you agree that we may suspend or terminate your access to your eligible accounts through this service. You will be notified of the termination. We will not be required to reinstate or re-activate your access. You may close your accounts or terminate your access to the online banking service at any time. We will terminate the service as soon as we can reasonably do so after we have received notice. We will not be required to reinstate or re-activate your service.

Fees

There are no fees for using the online banking service to access your accounts.

Electronic Mail and Links

The Bank will provide email service to you to communicate with the Bank. Please do not include confidential or personal information in your emails to the bank even when using the online service. Even though the website is secure, email is not as secure. Please use the website to initiate transactions or to change account information. We will respond to your email as soon as we reasonably are able to do so. Web links may be accessed from the Bank's website. These links are not monitored by the Bank and the Tri Valley Bank is not responsible for their content or security.

Disclaimer of Warranties and Limits on Liability

To the fullest extent permitted by law, we make no warranties of any kind for the online banking service, either express or implied. We do not warrant that the online banking service will be uninterrupted or error free, that defects will be corrected, or that our website that makes the online banking service available is free of viruses or other harmful components.

In no event will Tri Valley Bank or any of its officers, directors, shareholders, agents, affiliates, or third-party service providers be liable for any consequential, indirect, incidental, special or punitive damages, whether in an action under contract, negligence or any other theory, arising out of or in connection with this agreement, the online banking service or the inability to use the online banking service, even if advised to the possibility of such damages, except as permitted by law.
